150 Signatures Needed for Petition to Vote No on Proposed Yonkers Transfer Tax Increase to 3%

Most probably know by now about the proposed 2016-17 Yonkers Budget that includes a proposed tax rate increase of 0.95% which translates to an  annual increase of approximately $77 for the average home assessed at $11,300.

What you may not know is that Mayor Spano's budget also includes a Proposed Transfer Tax Increase  from 1.5% to 3%.  The tax would decline over a period of seven years back to 1.5%

What does that mean for the average homeowner?

"There is a Real Estate Transfer Tax on the sale of all real property in the City of Yonkers. This tax is 1.5% of the selling price and the seller is required to pay the tax.  No tax is required if a sale is $25,000 or less." 

Homeowners are upset and feel strongly that the proposed increase is an unfair burden on seniors and homeowners in general.  It will also adversely impact the sale of homes in Yonkers, NY which already has more than it's share of nuisance taxes.

While the proposed budget contains no cuts in services or layoffs and will mean additional money for the public schools it is only a temporary measure to a long term problem.

There is a movement via the Vote No - Sign the Change.org Petition to Yonkers City Council that you can sign to let your voice be heard.

Q&A: Tax Exclusion on an Inherited Home?

Image of inheritanceHere's a question you might hear more of in the years ahead. As many Baby Boomers age and pass on, their children will inherit their homes.
Q: My father died recently and I inherited his house. If I sell it, do I receive the same tax exemption on gains as I would with my own home?
A: No, but it might not matter much. If you did want to qualify for the $250,000/$500,000 exclusion, you'd have to live in the house and use it as your primary residence for a minimum of two years. However, special "stepped-up basis" rules apply for inherited homes.
A "basis" is the home's original cost for determining tax purposes. To determine gains, subtract the basis from the sales price. The basis is the cost of the home, plus any improvements. When you inherit your father's home, the basis is not the cost of the home when your father paid for it. Instead, the basis is stepped up to fair market value at the date of your father's death. This usually drastically reduces the gain.
In cases where you are forced to sell the home for less than the stepped-up basis, you may be eligible to take a capital loss on your taxes, though this maxes out at $3,000/year. The loss can be carried year-over-year, though. (For example: A loss of $27,000 would be carried for nine years.)

Are you entitled to a Veteran's Property Tax Exemption?

Did you know that Section 458-a of the Real Property Tax Law provides a limited exemption from real property taxes for real property owned by persons who rendered military service to the United States, provided such property meets the requirements set forth in the law?

The veteran must have served on active duty in the U.S. Armed Forces during:

  1.  Persian Gulf conflict (commencing August 2, 1990)
  2.  Vietnam War (February 28, 1961-May 7, 1975);
  3.  Korean War (June 27, 1950-January 31,1955);
  4.  World War II (December 7, 1941-December 31, 1946);
  5.  World War I (April 6, 1917-November 11, 1918);
  6.  Mexican Border Period (May 9, 1916-April 5, 1917), or
  7. Spanish-American War (April 21, 1898-July 4, 1902)
 and been honorably discharged or released from service.

The December 31 deadline has passed, but we are accepting late registrations

Register immediately to keep your Basic STAR exemption

Receiving Basic STAR but haven't registered yet? Act now before we notify your assessor to remove the exemption.
  • Senior citizens receiving the Enhanced STAR exemption are not affected by the new registration requirement. Learn more.
     
  • New homeowners applying for the Basic STAR exemption do need to register this year. Learn more.

Complete your registration online in just two to four minutes. You'll just need to:
  1. provide your STAR code (from the letter we sent or by using our STAR code lookup),
  2. provide the names and social security numbers for all owners of the property and spouses, and
  3. answer a few questions about the income and residency of the owners and their spouses.

January 21, 2014 is the last day that White Plains homeowners can file a tax grievance.

As the deadline to re-apply for the NYSTAR program is getting closer, I have been reminding everyone that I come into contact with not to forget.  I'm finding that some have "Never" applied....

NY Basic STAR Alert - December 31st Deadline


In case you haven't heard..... Recent legislation requires All homeowners that currently receive the NYS Basic STAR property tax exemption to re-apply in order to continue receiving the exemption in 2014.  Your 2013 exemption will not be affected.

The New York State Department of Taxation and Finance will begin mailing notices to Westchester County Homeowners on September 30th 2013.  Stay tuned for updates.......
